1. Agreement to These Terms
Welcome to Cost Effective Energy. In these Terms & Conditions (“Terms”), “we,” “us,” and “our” refer to Cost Effective Energy, the company that operates this website, mobile application, and related services (collectively, the “Service”). “You” refers to the person accessing or using the Service.
By accessing or using the Service, you agree to be legally bound by these Terms, which form a binding contract between you and Cost Effective Energy. You must be at least 18 years of age and legally authorized to enter into binding agreements to use the Service. If you do not agree with any part of these Terms, please discontinue use of the Service.
2. Nature of the Service
Cost Effective Energy is an independent energy broker and comparison platform. We provide access to pre-screened electricity offers to help you locate, evaluate, and enroll in electricity plans offered by third-party retail electricity providers (“Providers”). We are not a utility and do not generate, transmit, distribute, or sell electricity.
Use of the Service requires an active subscription, and optional related services may be offered. We are not a party to any contract between you and a Provider, and we do not set or control Provider rates, terms, or services. Pricing and terms for any electricity plan are governed solely by the agreement between you and your Provider, and each energy transaction is concluded directly between you and the Provider. Because rates and services are determined by Providers, we cannot and do not guarantee the rates, plans, approvals, or services they provide.
Your use of the Service and your reliance on any information, comparison, recommendation, estimate, or enrollment facilitated through it is at your own risk. You are responsible for independently reviewing all plan documents, contract terms, and pricing before enrolling.
3. Availability of Providers
The Service does not represent that it contains a complete or comprehensive list of all Providers available at your address. We may exclude Providers that do not meet our internal screening standards, so Providers able to serve your address may not appear on the Service. You are under no obligation to use the Service or to select any particular Provider listed on it.
4. Subscriptions and Fees
Access to the Service requires a paid subscription, billed monthly or annually, with a separate subscription required for each meter. By subscribing, you authorize recurring charges to the payment method on file. Subscriptions automatically renew at the end of each term at the then-current fee unless canceled at least 60 days prior to the end of the term. Subscription fees paid prior to cancellation are non-refundable to the extent permitted by applicable law.
We reserve the right to:
- Adjust subscription fees with at least 60 days’ prior notice; if you do not accept the new fees, you may cancel before they take effect.
- Suspend or cancel the Service if a payment fails, a payment method is rejected, or these Terms are violated.
- Charge a late fee on overdue balances, calculated as 1.5% per month of the past-due amount or the maximum rate permitted by applicable law, whichever is less.
- Refer unpaid accounts to a third party for collection, in which case you remain responsible for the unpaid charges and reasonable costs of collection permitted by law.
You are responsible for maintaining accurate payment information and for reviewing your statements for accuracy. If your payment method changes or expires, you authorize us to update it (including through information provided by your card issuer) and to continue charging amounts you owe. Each charge applies to the subscription period immediately following the billing date. All fees are listed in U.S. dollars.
5. Information You Provide
To provide quotes and facilitate enrollment, we may require information including your full legal name and contact details, date of birth, Social Security number (used by Providers for credit checks), State ID, service address, electricity usage information, and payment card details. You represent that all information you provide is accurate, complete, and current, and you agree to update it promptly if it changes.
6. Use of the Website and Services
Please use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Any speculative, false, or fraudulent order or request submitted to a Provider through the Service is prohibited. You agree to be financially responsible for your use of the Service and for all transactions made through it, including all charges, fees, taxes, and assessments arising from your orders. You are responsible for keeping your login credentials private, and activity conducted through your account is your responsibility. If these Terms are not followed, your account may be suspended or terminated.
7. Communication and Consent
In connection with your use of the Service, we may contact you by email or text with service announcements, administrative messages, billing notices, and other information relevant to your membership and electricity service. We may also occasionally share relevant industry information, frequently asked questions, and best-practice tips. You may opt out of promotional communications, but we may still send messages necessary for your account. Calls and chats with our team may be recorded for quality control, training, and dispute resolution. You acknowledge that we are not obligated to record any communication and that some communications may not be recorded or retrievable.
8. Energy Provider Authorization
By using the Service, you appoint Cost Effective Energy as your limited agent for the purpose of selecting and enrolling your service location for electricity service with retail electricity providers on your behalf from time to time. You authorize us to request and retrieve information related to your electricity usage and to establish accounts on your behalf where necessary, including with your Transmission and Distribution Service Provider (TDSP) or with Smart Meter Texas (SMT). Where such an account is established, your credentials will be made available to you on request, and you agree to abide by the applicable SMT terms and conditions. In addition to enrollments, you authorize us to contact a Provider on your behalf regarding your account.
You may withdraw this authorization at any time by contacting us. You acknowledge that withdrawing authorization may limit or prevent us from completing certain tasks on your behalf or from providing some of our services.
9. Intellectual Property
The materials, content, data, and information provided through the Service are the property of Cost Effective Energy or its licensors and are protected by applicable copyright and other intellectual property laws. Except as expressly permitted in these Terms, you may not distribute, transmit, display, reproduce, modify, create derivative works from, or otherwise exploit any materials available through the Service. “Cost Effective Energy” and related names, logos, and marks are the property of Cost Effective Energy or their respective owners, and you may not use them without prior written consent of the owner.
10. Disclaimers and No Guarantee of Outcomes
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we work to keep the Service available and accurate, we do not guarantee uninterrupted access, error-free operation, or the accuracy, timeliness, or completeness of any rate, plan, or Provider information, which changes frequently and may not reflect real-time conditions.
We do not guarantee any specific savings, rate reduction, plan approval, service activation, or other outcome resulting from use of the Service. Any projected savings, estimated costs, or rate comparisons are estimates only and are not a promise or representation of actual results. Actual results depend on factors outside our control, including your actual usage, market and Provider pricing changes, contract terms, utility rate adjustments, and Provider approval decisions.
If you elect for us to set up autopay with your Provider, we cannot guarantee that automatic payments will process correctly, and you remain responsible for ensuring your payments are made.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Cost Effective Energy and its affiliates, agents, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to the Service will not exceed the subscription fees you paid for the then-current term.
We are not responsible for the services, rates, terms, or conduct of any Provider; for any Provider’s failure to approve, activate, honor, or maintain a plan; or for disputes between you and a Provider, which should be resolved directly with the Provider. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law. Because some jurisdictions do not allow certain limitations, some of these limitations may not apply to you.
You agree to indemnify and hold harmless Cost Effective Energy, its employees, owners, representatives, and affiliates from claims, losses, and liabilities arising out of your use of the Service or your breach of these Terms, except to the extent caused by our own negligence or misconduct.
12. Data Retention and Termination
Upon termination of services, we will, within a reasonable period of up to 45 days, cancel any agreements made on your behalf or transfer access to you, unless you direct otherwise. We are not responsible for delays caused by third parties in cancelling or transferring agreements. We may continue to receive data for terminated or transferred agreements and may retain data collected during your membership as needed for legal or legitimate business purposes. We will not initiate new agreements on your behalf after the termination of service.
13. General
No joint venture, partnership, employment, or agency relationship (other than the limited agency expressly described above) is created by these Terms or your use of the Service. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, or replaced with a valid provision that most closely reflects its intent, and the remaining provisions will continue in effect. These Terms constitute the entire agreement between you and us regarding your use of the Service. A printed version of these Terms and of any notice given electronically will be admissible in proceedings relating to these Terms to the same extent as other business records maintained in printed form. Any rights not expressly granted are reserved.
14. Modifications to These Terms
We may update or change these Terms from time to time. Material changes will be posted on this page, and your continued use of the Service after changes take effect means you accept the updated Terms.
