Except as expressly provided for in this Agreement, you may not distribute, transmit, display, reproduce, modify, create derivative works from, or otherwise exploit any of the materials available through the Service.

Cost Effective Energy and the names of other products and services referenced through the Service are the trademarks of Cost Effective Energy, LLC and their respective owners. You may not use any trademark or service mark appearing through the Service without the prior written consent of the owner of the mark.

Fee

The use of the Cost Effective Energy site requires an active service subscription, which is available on a monthly or annual basis, with a separate subscription required for each meter. Unless canceled at least thirty (30) days prior to the end of the current term, subscriptions will automatically renew at the same fee. Subscription fees are non-refundable, even if you stop using the Service before the end of the subscription term. Services may include optional add-ons, and the pricing of electricity plans remains subject to agreements directly between you and your energy provider. We reserve the right to suspend or cancel service at any time if these Terms are violated.

Use of the Website

You agree to use this site and the services only for lawful purposes and in accordance with these Terms. Unauthorized use may result in suspension, termination, or legal action. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. By using our services, you represent that you are at least eighteen (18) years of age and possess the legal authority to enter into agreements with energy providers.

Payment Terms

By subscribing to our services, you authorize us to charge the applicable subscription fees to the payment method on file. Unless canceled, your subscription will automatically renew, and you authorize us to continue charging your account each billing cycle. You are responsible for maintaining current and accurate payment information, including card number, expiration date, and billing address. If your payment card expires or is replaced, you authorize us to obtain updated payment information from your issuer and to continue charging the card. Charges will apply to the subscription period immediately following the billing date. All prices on this site are listed in U.S. Dollars. We reserve the right to increase subscription fees for month-to-month subscribers upon thirty (30) days’ prior notice. If you do not accept the new fees, you should terminate your subscription before the new fees become effective. If your payment fails, we may suspend or terminate your service without notice, assess late fees on overdue amounts, and pursue collection of unpaid balances. You remain responsible for all outstanding charges and for any collection costs we incur.

Communication and Consent

You may opt out of promotional communications at any time, but service-related communications cannot be disabled. Phone calls and online chats with our team may be recorded for quality assurance, training, and dispute resolution purposes.

Limitation of Liability

The Service is provided to you “as is.” Cost Effective Energy does not guarantee uninterrupted access, error-free operation, or specific outcomes from the use of the Service. We and our affiliates are not liable for any damages arising from your use of the Service, including without limitation indirect, incidental, or consequential losses. To the extent liability cannot be excluded, our liability is limited to the amount of subscription fees paid during the current service term. You agree to indemnify and hold harmless Cost Effective Energy, its employees, representatives, and affiliates from any claims or liabilities arising from your use of the Service.

Energy Provider Agreements

Contracts for electricity service are made directly between you and third-party providers. Cost Effective Energy acts solely as your limited agent to evaluate electricity plans and, when authorized, to enroll you in them. By using our services, you authorize us to access your electricity usage data and to communicate with energy providers on your behalf. This may include the creation of accounts with utilities or services such as Smart Meter Texas (SMT). You may rescind this authorization at any time by contacting us, but doing so may restrict or prevent us from providing the Service.

Data Retention and Termination

Upon termination, we will cancel or transfer third-party agreements within 45 days, unless otherwise instructed. However, we retain data collected during your membership to comply with legal or business requirements.

Modifications to Terms

We have the right to update these terms and conditions of services at any time. Continued use of our services after changes are posted constitutes your acceptance of the updated terms.

Terms & Conditions: Commercial

This site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of this site constitutes your agreement to all such terms, conditions, and notices. This site is powered and operated by Cost Effective Energy (“Cost Effective Energy,” “we,” or “us”). You must be 18 years of age or older to use this site.

Cost Effective Energy is a service of Cost Effective Energy, LLC. that, among other things, allows subscribers to locate, evaluate, and enroll in energy services through third-party providers. By using the Service, you accept the terms of this Agreement. This is a legally binding agreement between you and Cost Effective Energy.

Cost Effective Energy operates solely as a service provider by providing subscribers access to pre-screened energy offers. We are not a party to any contract concluded pursuant to the Service and do not guarantee third-party services or rates. Use of the Service requires an active subscription (“Member”).

The Service is available to Members to assist in the purchase of energy. Optional add-on services may also be purchased. The price and other terms remain subject to agreements between the buying Member and the third-party provider. Cost Effective Energy cannot guarantee the rates and/or services provided by the third-party vendor.

Cost Effective Energy reserves the right to cancel or suspend a Member’s account at any time and without notice upon a breach, violation, or non-compliance of this Agreement or any other policies, terms of use, or agreements of Cost Effective Energy. Notwithstanding the foregoing, under no circumstances shall Cost Effective Energy be required to issue refunds hereunder.

Each energy transaction shall be consummated directly between the Member and the third-party provider, and Cost Effective Energy has no interest, as a broker or otherwise, in such transactions.

Energy plan contracts are made directly between the Member and the third-party provider. Each Member appoints Cost Effective Energy as their limited agent for purposes of evaluating and enrolling in electricity plans. By using the Service, you authorize Cost Effective Energy to access your electricity usage data and communicate with providers on your behalf. This may include establishing accounts with utilities or with Smart Meter Texas (“SMT”), where applicable. Members agree to abide by the SMT Terms and Conditions whenever an account is established on their behalf. Any Member can rescind this authorization by contacting us at support@costeffectiveenergy.com. The Member acknowledges that our ability to support Member services may be limited or compromised without these authorizations.

Data Retention and Termination

Upon termination of services, Cost Effective Energy will cancel or transfer any third-party agreements made on your behalf within a reasonable period, up to 45 days, unless otherwise instructed. We reserve the right to retain data collected during your membership as necessary to comply with business or legal obligations.

Modification of These Terms and Conditions

We reserve the right to update or change these terms, conditions, and notices at any time. Continued use of the Service following such changes constitutes your agreement to the updated terms.
